Fimio, Inc. (““Fimio,” “we,” “us,” or “our”) has prepared this Privacy Policy to explain (1) what personal information we collect, (2) how we use and share that information, and (3) your choices concerning our privacy and information practices.
Please read this Privacy Policy carefully. By using the Services, you agree to this Privacy Policy and its terms. If you do not agree to this Privacy Policy, please do not use or access any of the Services.
1. APPLICABILITY OF THIS PRIVACY POLICY
This Privacy Policy applies to Fimio’s next-generation platform for collaborative reproducible builds that close the gap between code and deploy our website(s), including https://fimio.xyz, (the “Site”) and other interactions you may have with Fimio (together, the “Services”).
This Privacy Policy does not cover the use of the Services by business customers who have a separate agreement with us that governs their access and use of the Services (the “Customer Agreement”), including the processing of personal information or other data by Fimio in connection thereof (collectively, “Customer Data”). The organization (e.g., your employer or another entity or person) that entered into the Customer Agreement (“Customer”) controls the accounts it has created for use of the Services and any associated Customer Data, and we will process Customer Data in accordance with the Customer Agreement. However, this Privacy Policy will apply to business customers who use our Services pursuant to our Terms.
Our Services are designed for users in the U.S. only and are not intended for users located outside the U.S.
2. PERSONAL INFORMATION COLLECTION
When you use or access the Services, we may collect certain information about you. Some features of the Services may require you to enter information about yourself. You may decide not to provide this information, but doing so may prevent you from using or accessing these features.
- Contact Information such as your name, email address, phone number, company and role. We may collect this information if you are a representative of one of our actual or prospective customers, suppliers or business partners (e.g., when discussing our Services with you and during the course of our relationship with your company), from individual customers who use our Services, and when you respond to our questionnaires, surveys or requests for market research seeking your opinion, or otherwise express interest in our products and services.
- Account Information such as username, password, your account handle, profile picture and your IP address. If you choose to register an account, you are responsible for keeping your account credentials safe. We recommend you do not share your access details with anyone else. If you believe your account has been compromised, please contact us immediately.
- Payment and subscription information, such as credit or debit card information and billing address, which is collected on our behalf by our payment processor, and information about your purchases and subscription tier.
- Project Information, such as the code, project name and summary, and other information associated with projects and workflows that you create on the Services. This information may, depending on what it is and how it is associated with your account, contain personal information. If your projects are public, others (including individuals who are not users of the Services) may be able to access and subsequently store, display, reproduce, publish, or otherwise use your project (including with your account handle), and may or may not attribute it to you.
- Other information you choose to provide in communications with us, such as your name, email address and other information you provide.
Information We Collect Automatically: When you use the Service or visit the Sites, we and third parties on our behalf may automatically collect the following information about your interactions with the Services, including through cookies and other tracking technologies (“Tracking Technologies”). We collect and use this information to tailor your experience with the Services, run analytics, de-bug, better understand user interactions with and improve the Services. We may associate this information with the device you use to access the Services, or email accounts you use to engage with us.
- Device Information: The manufacturer and model, operating system, browser type, IP address, and unique identifiers of the device you use to access the Service. The information we collect may vary based on your device type and settings.
- Usage Information: Information about how you use our Service, such as the types of content that you view or engage with, the features you use, the actions you take, and the time, frequency, and duration of your activities. For example, we use Google Analytics, a web analytics service provided by Google LLC (“Google”) to help collect and analyze Usage Information. - Location Information: We may derive a rough estimate of your location from your IP address when you visit our website or use the Service.
Information Collected from Other Sources. We may also obtain information about you from outside sources, including information we receive when you use login integrations, such as when you access the Services through GitHub or GitLab.
3. PERSONAL INFORMATION USE
We use information to operate our Services, Sites and business, including for the following purposes:
- Service Delivery, including to provide, operate, maintain, and secure the Services;
- Communicating with You, including to send you updates about administrative matters such as changes to our terms or policies, and provide customer support, and respond to your requests, questions and feedback.
- Service Improvement, including to improve our products and services and create new features, personalize your experience, monitor and analyze trends and conduct internal research and development.
- Marketing and Advertising, including to send you marketing communications, including notifying you of special promotions, offers and events via email and other means.
- Compliance and Protection, including to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities; protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); audit our compliance with legal and contractual requirements and internal policies; and prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.
Aggregated and/or De-Identified Information. Fimio may also deidentify or aggregate information for machine learning and data analytics for these and any other lawful purpose.
4. PERSONAL INFORMATION SHARING
We may share personal information for legitimate purposes subject to this Privacy Policy, including with:
- Vendors and Service Providers, including hosting services, email services, advertising and marketing services, Tracking Technology providers, payment processors, customer support services, and analytics services.
- Third Parties when you request or direct us to share your information, such as through your use of login integrations, when you create public projects or interact with other users on the Services, or otherwise with your consent or direction.
- Professional Advisors, such as lawyers and accountants, where doing so is necessary to facilitate the services they render to us.
- Business Transaction Recipients, such as counterparties and others assisting with a merger, acquisition, financing, reorganization, bankruptcy, receivership, dissolution, asset sale, or similar transaction, and with successors or affiliates as part of or following that transaction.
- Government Authorities, including regulators, law enforcement, public authorities or other relevant organizations where required to do so for the Compliance and Protection purposes described above.
- Affiliates, including current and future affiliates, who may use the personal information in a manner consistent with this Privacy Policy.
5. TRACKING TECHNOLOGIES
We use Tracking Technologies, including Google Analytics, to collect information about your browsing activities, including your browsing over time and across different websites following your use of our Services. Most browsers accept Tracking Technologies automatically, but you may be able to control the way in which your devices permit the use of Tracking Technologies. If you so choose, you may block or delete certain Tracking Technologies from your browser; however, blocking or deleting Tracking Technologies may cause some of the Services, including login features and general functionality, to work incorrectly.
Your browser settings may also allow you to transmit a “Do Not Track”. Like many websites, our website is not designed to respond to such signals. Learn more about “Do Not Track” signals here. To opt out of tracking by Google Analytics, you can download and install a plug-in available here.
6. SERVICE LOCATION
Fimio, Inc. currently only operates in the United States. By using the Services, you agree and acknowledge that your personal information will be transferred from your location to our and our service providers’ facilities and servers in the United States.
7. CHILDREN
Our Services are not intended for children who are under the age of 13, and Fimio does not knowingly collect personal information from children under the age of 13. If we learn that we have unknowingly collected personal information from a child under the age of 13, we will make commercially reasonable efforts to delete that information. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the below information to request that it be deleted.
8. THIRD PARTY WEBSITES
The Service may contain links to other websites not operated or controlled by Fimio, including social media services. If you follow links to sites or platforms that we do not control and are not affiliated with us, you should review the applicable privacy notice, policies and other terms. We are not responsible for the privacy or security of, or information found on, these sites, or the accuracy, completeness or reliability of third-party materials. Information you provide on public or semi-public venues, such as third-party social networking platforms, may be viewable by other users of the Services and / or users of those third-party platforms without limitation as to its use. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators.
9. SECURITY
We take reasonable steps intended to protect the personal information provided to the Service from loss, misuse and unauthorized access, disclosure, alteration, and destruction. However, no network or email transmission is fully secure or guaranteed to be error free and any information you send to us, while using the Services or otherwise, may not be secure in transit. In particular, email sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via email and recommend that you do not use unsecure channels to send us sensitive or confidential information, as we cannot guarantee “perfect security”.
10. YOUR CHOICES
Opt Out of Marketing Communications: You may opt out of marketing communications by following the unsubscribe instructions in any marketing email we send you. Please note, however, that you may continue to receive communications as described in the Communicating with You section after opting out of marketing communications.
11. CHANGES TO THE PRIVACY POLICY
The Service and our business may change from time to time. As a result we may change this Privacy Policy at any time, in which case we will update the “Last Updated” date. If we make material changes to the way we use information we collect, we will use commercially reasonable efforts to notify you and will take additional steps as required by applicable law. If you do not agree to any updates to this Privacy Policy, please do not use or access any of the Services.
